La legge n. 92/2012 "Riforma del mercato del lavoro in una prospettiva di crescita" ha apportato significative novità in materia di disciplina di risoluzione dei contratti di lavoro. Sono stati introdotti una serie di interventi, sotto il profilo sia sostanziale che processuale, in tema di licenziamenti individuali, licenziamenti collettivi, dimissioni, risoluzione consensuale del rapporto di lavoro, ammortizzatori sociali e rito del lavoro. Le novità introdotte dalla Riforma Fornero in materia di licenziamento ed in particolare in materia di licenziamento per giustificato motivo oggettivo, sono rilevanti, basti pensare alla rigida procedura che il datore di lavoro è tenuto ad osservare preventivamente all'attuazione del licenziamento, oppure alla possibilità, in presenza di talune forme di riscontrata illegittimità del licenziamento, di non reintegrare il lavoratore. Queste novità sono destinate ad incidere in misura significativa in particolare sulle risoluzioni dei rapporti di lavoro alle quali si applica l'art. 18 della legge n. 300 del 1970.
