Die Annahme von Verpflichtungszusagen durch die Europäische Kommission ist ein beliebtes Instrument zur Beendigung von Kartellverfahren. Die Kommission hat dieses Instrument bereits in Verfahren gegen Microsoft oder Apple angewandt und dadurch das Kartellrecht nachhaltig verändert. Die Anwendung des bedeutsamen Grundsatzes der Verhältnismäßigkeit auf Verpflichtungszusagen wurde bisher noch nicht umfassend aufgearbeitet. Das vorliegende Werk schließt diese Lücke und geht zunächst der Frage nach, inwieweit aus dem Verhältnismäßigkeitsgrundsatz ein Vorrang der Verpflichtungszusage gegenüber anderen kartellrechtlichen Instrumenten abgeleitet werden kann. In weiterer Folge wird die Anwendung des Verhältnismäßigkeitsgrundsatzes als Instrument zur gerichtlichen Überprüfung den Verpflichtungsbeschlüssen in den Blick genommen. Dabei zeigt sich, dass der Grundsatz seine wesentlichen Vorzüge gerade auch bei Verpflichtungszusagen entfalten kann.
