Die europarechtlich überlagerte Vorschrift des § 613a BGB hat höchste praktische Relevanz und gilt angesichts ihres zwingenden Charakters und ihrer Komplexität als besonders umgehungsanfällig. Bislang nur wenig beachtet ist die Frage, inwieweit die einseitige Zuordnung von Arbeitnehmern zu Betrieben oder Betriebsteilen durch den Betriebsinhaber im Vorfeld eines Betriebsübergangs eine unzulässige Umgehung von § 613a BGB und der darin gesetzlich angeordneten Arbeitsvertragsübernahme darstellen kann.Die vorliegende Arbeit erörtert die Grundsätze der Gesetzesumgehung im Betriebsübergang und untersucht die vorhandenen Ansichten zur Umgehungsrelevanz von betriebsübergangsnahen Zuordnungen. Ausgehend hiervon entwickelt der Autor einen schutzzweckbezogenen und fallgruppenorientierten Lösungsweg für betriebsübergangsnahe Zuordnungsmaßnahmen des Betriebsinhabers, der den Gleichlauf von Arbeitsverhältnis und funktionellem Arbeitsplatz in den Vordergrund der Umgehungsprüfung stellt.
