Dieses Buch zeichnet Schwierigkeiten der Judikative im Zusammenhang mit der rechtlichen Schenkkreisproblematik auf und untersucht die Motive in der Anwendung bzw. Nichtanwendung der maßgeblichen Vorschrift des § 817 S. 2 BGB. Es analysiert ferner Ursprung und Entwicklung dieser Norm seit ihrer Entstehung bis zur heutigen Zeit. Einerseits erkennt die überwiegende Mehrheit der Juristen, dass diese Norm oft zu Ergebnissen führt, die mit dem Rechtsempfinden nicht im Einklang stehen. Andererseits bleibt es allein der Politik überlassen diese Vorschrift abzuschaffen. Rechtsunsicherheit entsteht dadurch nicht.
