About This Book

Die Auswahl des Insolvenzverwalters ist im deutschen Recht nur rudimentär bis gar nicht geregelt. Dies wirft verfassungs-, aber auch europarechtliche Bedenken auf. Nach einem generellen Überblick über das Verwalterauswahlwesen fokussiert die Arbeit auf die Vereinbarkeit dessen mit der EU-Dienstleistungsrichtlinie. Dabei wird zunächst erörtert, ob die Tätigkeit der Insolvenzverwaltung überhaupt von deren Anwendungsbereich umfasst ist. In einem weiteren Schritt erfolgt eine Analyse der Verwalterauswahl am Maßstab der Richtlinie. Besonderer Erörterung bedürfen dabei der Ausschluss juristischer Personen sowie die richterliche Praxis der Listenführung. Sie stellen letztlich aber nur Teilaspekte dar, die belegen, warum die Verwalterauswahl europarechtswidrig und reformbedürftig ist.
