Gegenstand der Arbeit ist der Rahmenbeschluss des Rates vom 18.Dezember2008 über die Europäische Beweisanordnung zur Erlangung von Sachen, Schriftstücken und Daten zur Verwendung in Strafsachen. Der Rahmenbeschluss ist insoweit die Grundlage und der Rechtsrahmen für die Erlangung europaweit verkehrsfähiger Beweise und deren Verwendung im Strafverfahren. Im Rahmen einer kritischen Auseinandersetzung werden die damit verbundenen grund- und verfahrensrechtlichen Folgen aufgezeigt. Ziel der Untersuchung ist die differenzierte Beantwortung der Frage, ob durch «europäische Beweise» ein europaweiter Beweistransfer möglich ist, der den straf(prozess)rechtlichen Grundsätzen entspricht, und wie ein solcher gestaltet werden kann.
