Internationale Konzerne und Einheitsunternehmen legen ihren internen Geschäftsbeziehungen häufig unangemessene, einem Fremdvergleich nicht standhaltende Bedingungen zugrunde. Die Finanzverwaltungen nehmen sodann eine Korrektur der innerkonzernlichen Verrechnungspreise und der unternehmensinternen Gewinnaufteilung vor. Weichen die Bewertungen der beteiligten Staaten voneinander ab, kann es zu Doppelbesteuerungen kommen. Zur Vermeidung oder Beseitigung solcher Doppelbesteuerungen stehen verschiedene verfahrensrechtliche Instrumente, wie präventiv wirkende Vorabverständigungsverfahren (Advance Pricing Agreements) und die reaktiven abkommens- und europarechtlichen Verständigungs- und Schiedsverfahren, zur Verfügung.
