Im Bereich des Regulierungsrechts zeigt sich eine intensive sektorspezifische Förderung der Verbraucherrechte. Der Verfasser zeigt dies an den verbraucherschĂŒtzenden Vorschriften des Telekommunikationsgesetzes vor dem Hintergrund der erfolgten Änderungen durch die Novellierung 2012 auf. Über die bestehende Regelungsmaterie wird ein umfassender Überblick gegeben, die Materie bewertet und nach RegelungsansĂ€tzen systematisiert. Es wird festgestellt, dass der gegenwĂ€rtige Verbraucherschutzansatz durch die besondere SchutzbedĂŒrftigkeit des Verbrauchers gerechtfertigt ist, welche auf die spezifischen Besonderheiten des Marktumfeldes zurĂŒckgefĂŒhrt werden kann. Der Verbraucher wird im Rahmen der Regelungsintention aber sehr wohl als informierter und mĂŒndiger Akteur wahrgenommen.
