Die Autorin beschĂ€ftigt sich zum einen mit der theoretischen Frage, wie Tat- und Rechtsfrage, wie TatsĂ€chliches und Rechtliches im tatrichterlichen Urteil am besten zu scheiden sind und versucht zum anderen die dogmatisch hergeleitete Abgrenzungstheorie auf ihre Praxistauglichkeit zu testen. Durch Vornahme einer Rechtsprechungsanalyse der aktuellen Entscheidungen der Obergerichte ermittelt sie die Bedeutung der Abgrenzung von Tat- und Rechtsfrage in der modernen RevisionsrealitĂ€t fĂŒr die Frage des revisibelen Bereichs im Sinne von § 337 StPO und die ZulĂ€ssigkeit des Divergenzvorlageverfahrens gemĂ€ĂŸ §§ 121 Abs. 2, 132 Abs. 2 GVG und wirft die Abgrenzungsfrage neu auf.
