Der Autor geht der Frage nach, inwiefern das Europäische Parlament als Parlament definierbar ist. Erst seit dem Vertrag von Maastricht bezeichnen die Primärverträge die vormalige Versammlung der «Vertreter der Völker» als «Europäisches Parlament». Laut Vertrag von Lissabon aus dem Jahre 2009 ist das Europäische Parlament der Ort, an dem «die Bürgerinnen und Bürger... auf Unionsebene unmittelbar... vertreten» werden. Zurückhaltender urteilt das BVerfG in seinem Lissabon-Urteil, demzufolge es sich in der Sache weiterhin um eine Vertretung der Völker der Mitgliedstaaten handelt. Die republikanische Zwecksetzung eines Parlaments ist die Verwirklichung des Rechts durch die Bürger für die Bürger. Das ist der Maßstab, den der Autor an das Europäische Parlament mit seinen primärvertraglichen Befugnissen anlegt.
