Pränatale Schädigungen stehen bereits seit dem Contergan-Skandal in der Diskussion, haben jedoch in den letzten Jahren aufgrund des medizinischen Fortschritts und einer aus den Vereinigten Staaten stammenden Debatte über den Umgang mit schädigenden Verhaltensweisen einer schwangeren Frau neue Impulse erhalten. Die Arbeit untersucht die verfassungsrechtlichen Vorgaben für den Schutz des sich entwickelnden menschlichen Lebens und analysiert die vorhandenen Regelungen im einfachen Recht. Insbesondere der strafrechtliche Schutz gegen pränatale Einwirkungen, die zu postnatalen Gesundheitsschädigungen führen, erweist sich als unvollständig. Vor diesem Hintergrund wird ein eigenständiges Schutz- und Haftungskonzept entwickelt.
