Das Buch befasst sich mit einer zentralen Frage des Strafprozessrechts: Darf der Beschuldigte im Ermittlungsverfahren getäuscht werden? Meist nur zu Einzelfragen diskutiert, fehlt es dazu bisher an einer breiten Grundsatzdebatte und an einer monographischen Befassung. Anhand des Anwendungsbeispiels so genannter legendierter Kontrollen nähert sich der Autor dem Thema von zwei Seiten: Zuerst beleuchtet er rechtsdogmatisch die grundsätzliche Zulässigkeit aktiver Täuschung. Anschließend erfolgt die Bewertung vor dem Gebot der effektiven Strafverfolgung, welches dafür als Verfahrensgrundsatz untersucht, aber auch in einem eigenen Entwurf rechtsphilosophisch fundiert wird. Der Autor zeigt auf, dass die Täuschung des Beschuldigten grundsätzlich erlaubt ist und sogar geboten sein kann.
