Die richterrechtlich geschaffene ergänzende Vertragsauslegung schließt Lücken in Verträgen. Sie überschreitet die Grenzen der Auslegung und steht in Konkurrenz zur Lückenfüllung durch das dispositive Recht. Obwohl sie zum Grundinventar der vertraglichen Methodik gehört, herrscht Unsicherheit über ihre Voraussetzungen und den Anwendungsbereich. Die Autorin weist auf Basis einer Analyse der Voraussetzungen der Vertragslücke und vor allem anhand von Leitentscheidungen nach, dass es zwei grundsätzlich zu unterscheidende Formen der ergänzenden Vertragsauslegung gibt, die beide ihre Berechtigung haben: die individuelle, den konkreten Vertrag zu Ende denkende sowie die generelle Lücken des dispositiven Rechts überbrückende Form.
