Die Zwangslizenzierung von Immaterialgüterrechten – etwa von Patenten oder Urheberrechten – aufgrund einer missbräuchlichen Lizenzverweigerung gemäß Art. 102 AEUV ist besonders von ökonomischen Erwägungen getragen. Der Autor untersucht anhand der rechtlichen und ökonomischen Grundlagen beider Rechtsgebiete die gerichtliche Entscheidungspraxis auf Unionsebene, die sich ihrerseits auf das Wettbewerbsverhalten von Unternehmen auswirkt. Als Leitbeispiel dienen die Verfahren gegen das Unternehmen Microsoft. Zudem betrachtet der Autor kritisch die bisweilen geringe Bedeutung der Grundrechte sowie die stark zurückhaltende Rechtskontrolle der Unionsgerichte im europäischen Wettbewerbsrecht.
