Die Autorin widmet sich der Betrachtung der internationalen Personengesellschaftsbesteuerung, insbesondere der grenzĂŒberschreitend gezahlten SondervergĂŒtungen und der daraus folgenden abkommensrechtlichen Behandlung. Treffen verschiedene Rechtssysteme aufeinander, kann es aufgrund der divergierenden Besteuerung von Personengesellschaften zu Qualifikationskonflikten kommen. Der nationale Gesetzgeber versucht durch § 50d Abs. 10 EStG das inlĂ€ndische Besteuerungsrecht an grenzĂŒberschreitend gezahlten SondervergĂŒtungen zu sichern, wohingegen der Bundesfinanzhof an der autonomen Auslegung von Doppelbesteuerungsabkommen festhĂ€lt. Schwerpunkt des Buches ist die Analyse der Reichweite sowie die VerfassungsmĂ€ĂŸigkeit des § 50d Abs. 10 EStG. Weiterhin stehen die Zuordnung der SondervergĂŒtung zu einer BetriebsstĂ€tte sowie der Zuordnungsmaßstab im Vordergrund.
