Der präventive Restrukturierungsrahmen wird je nach Ausgestaltung erhebliche Auswirkungen auf das bestehende deutsche Sanierungs- und Insolvenzrecht haben. Das Werk analysiert die vom deutschen Gesetzgeber spätestens bis zum 17. Juli 2022 zwingend umzusetzenden Vorgaben der Richtlinie (EU) 2019/1023 vom 20. Juni 2019 zur Schaffung dieses Rechtsrahmens umfassend, stellt die verbleibenden Umsetzungsspielräume dar, zeigt Inkonsistenzen auf und gibt Anreize für die Umsetzung in deutsches Recht. Das Werk bietet damit für die weitere Diskussion der Implementierung dieses Rechtsrahmens eine Orientierungshilfe und ist auch für eine spätere richtlinienkonforme Auslegung des auf der EU-Richtlinie fußenden deutschen Rechts höchst aufschlussreich.
