Die Aufrechterhaltung der Arbeitsabläufe stellt das Interesse eines jeden Arbeitgebers während eines Arbeitskampfes dar. Hierzu bedienten sich Arbeitgeber unter anderem des Einsatzes von Leiharbeitnehmern als Streikbrecher. Diese Möglichkeit entzog der Gesetzgeber Arbeitgebern durch die Novellierung des § 11 Abs. 5 AÜG. Mit Blick auf die hierbei zugrunde gelegten Gesetzesmotive wird in dieser Arbeit die arbeitskampfrechtliche Stellung von Leiharbeitnehmern im Entleiherbetrieb beleuchtet und eine vertiefte Prüfung der Vereinbarkeit mit höherrangigem Recht vorgenommen. Außerdem werden ausführlich Voraussetzungen, Reichweite und Rechtsfolgen des neu eingeführten Einsatzverbotes sowie des beibehaltenen Leistungsverweigerungsrechts untersucht.
