Auf dem Boden der zivilprozessualen Grundlagen zur Beweisführung und Beweislast zeigt die vorliegende Dissertation indes die zahlreichen beweisrechtlichen Fragestellungen auf, mit denen sich die Beteiligten des Verfahrens regelmäßig konfrontiert sehen. Insbesondere soweit die gerichtliche Pflicht zur Sachverhaltsaufklärung ausnahmsweise suspendiert und eine initiale Beibringung von Tatsachen verlangt wird, ist die Verteilung der Darlegungs- und Beweislast entscheidend.
