Deutschland hatte mit der Weimarer Reichsverfassung den Aufbruch zur Demokratie gewagt: Die Republik sollte demokratisch, sozial und rechtsstaatlich sein, Ausgangspunkt war die Volkssouveränität. Das Verhältniswahlsystem aber begünstigte kleine Parteien und erschwerte damit die Regierungsbildung. Die letzten Reichsregierungen waren Präsidialkabinette.Verfassungen werden gemeinhin von verschiedenen Wissenschaftsdisziplinen analysiert. Während die Philosophie und die Historiographie den Rahmen vorgeben, darf die Staats- und Verfassungsrechtslehre als "Königsdisziplin" gelten.
