Die Arbeit sucht einen konzeptionellen Rahmen für ein unionsrechtskonformes Gemeinnützigkeitsrecht zu zeichnen. Sie geht kritisch der Rechtspraxis vieler EU-Mitgliedstaaten auf den Grund, die in der Umsetzung der Stauffer- und Persche-Entscheidung des EuGH dazu übergegangen sind, ausländische Organisationen schlicht an den Gemeinnützigkeitsvoraussetzungen des Tätigkeitsstaats zu messen (sog. "strikter" Vergleichbarkeitstest). Der Fokus der Arbeit liegt auf der Unionsrechtskonformität des "strikten" Vergleichbarkeitstests, der Auslandsöffnung der staatlichen Kontrollsysteme, der Einführung "neuer" nationaler Faktoren in die nationalen Gemeinnützigkeitsrechte sowie der Schaffung der vorerst gescheiterten Rechtsform der Europäischen Stiftung.
