Anhand exemplarischer Fälle aus der Praxis sowie der Befragung von Insolvenzverwaltern beleuchtet die Autorin die Frage, ob es eines strafprozessualen Zeugnisverweigerungsrechts für Insolvenzverwalter bedarf. Die Untersuchung erfolgt dabei im Hinblick auf die Wahrung strafprozessualer Rechte von Insolvenzschuldnern als spätere Beschuldigte eines Strafverfahrens. Basierend auf den bereits existenten Ansätzen in Judikatur und Literatur sowie unter Berücksichtigung der eigenen Umfrageergebnisse werden Lösungen de lege lata und de lege ferenda im einfachgesetzlichen Bereich hergeleitet.
