About This Book

El retraso en el cumplimiento de las obligaciones es uno de los temas centrales del Derecho de obligaciones y contratos. En este trabajo se realiza un estudio que parte del tratamiento del retraso que se realiza en el ordenamiento español, junto con el que se observa en los textos (normativos y propuestas) que forman parte del movimiento europeo de modernización, actualización y unificación del Derecho de obligaciones y contratos. Para ello, se efectúa un análisis detallado tanto del Derecho español, como de los distintos textos que componen el movimiento, complementado por el examen del Derecho comparado cuando resulta relevante; y se pone atención, desde esta perspectiva, sobre mecanismos relacionados con el retraso como la mora del deudor, el Nachfrist o mecanismo de plazo adicional, o la resolución.
