Ausgelöst durch die beiden europĂ€ischen Antidiskriminierungsrichtlinien 2000/43/EG und 2000/78/EG hat sich eine umfĂ€ngliche Diskussion zum Antidiskriminierungsrecht entwickelt, bei der Detailprobleme der neuen Regelungen im Vordergrund stehen. Ein ĂŒberzeugender Umgang mit dem Antidiskriminierungsrecht kann jedoch nur gelingen, wenn die Einzelfragen in eine ĂŒbergreifende Gesamtkonzeption eingebettet sind. Diskriminierungen zu vermeiden, wird in zunehmendem Maße nicht nur als allgemein gesellschaftlicher Wert angesehen, son-dern auch als ethisches Prinzip, das ĂŒber die Richtlinien und das Allgemeine Gleichbehand-lungsgesetz Eingang in das Recht findet. Jenseits von rein anwendungsbezogenen Problemen konzentriert sich die vorliegende Untersuchung auf grundlegende rechtstheoretische und rechtsethische Fragen.Ausgehend von einer eingehenden Analyse des Begriffs der Diskriminierung und der Diskri-minierungsnormen, werden die geltenden zivilrechtlichen Regelungen analysiert. Im zweiten Teil werden diese Normen auf ihre rechtsethische Vereinbarkeit mit den Theorien von Kant, Rawls, Nozick, von der Pfordten und Walzer ĂŒberprĂŒft.
