About this book

Der Untersuchungsgegenstand dieser Dissertation ist die sog. Vorratsdatenspeicherung von Telekommunikationsverkehrsdaten. Zu Beginn wird der technische Hintergrund der Vorratsdatenspeicherung sowie ihre Bedeutung und Akzeptanz in der Gesellschaft herausgearbeitet. Im nachfolgenden Teil analysiert die Dissertation mit der Richtlinie 2006/24/EG den europarechtlichen Ursprung der Vorratsdatenspeicherung, stellt diese rechtsvergleichend in der EuropĂ€ischen Union insgesamt und speziell im Vereinigten Königreich, in Österreich und in der Schweiz dar und unterzieht sie einer kritischen WĂŒrdigung. Anschließend setzt sich die Untersuchung mit den verfassungsrechtlichen Vorgaben fĂŒr eine Vorratsdatenspeicherung in Deutschland auseinander, wobei insbesondere das Urteil des Bundesverfassungsgerichts vom 02.03.2010 im Fokus steht. Im fĂŒnften Teil wird die Vereinbarkeit der RL 2006/24/EG mit den EuropĂ€ischen Grundrechten ĂŒberprĂŒft und die Notwendigkeit einer Novellierung der Richtlinie diskutiert. Zuletzt wird auf der Grundlage der gewonnenen Erkenntnisse der Versuch unternommen, die telekommunikationsrechtlichen und strafprozessualen Vorschriften fĂŒr eine Neuregelung der Vorratsdatenspeicherung in Deutschland zu entwerfen.
