Der Band analysiert die in der KWK-Novelle 2008 vorgesehene Zuschlagzahlung für den Neu- und Ausbau von Wärmenetzen. Diese bildet einen wichtigen Bestandteil des "Integrierten Energie- und Klimaprogramms der Bundesregierung". Die Untersuchung gelangt zu dem Ergebnis, dass diese Weiterentwicklung mit den Vorgaben der KWK-Richtlinie (2004/8/EG) ebenso vereinbar ist wie mit der Waren-verkehrsfreiheit nach Art. 28 EG und dem Beihilferecht nach Art. 87 und 88 EG. Größere Schwierigkeiten bereitet die grundrechtliche Beurteilung, in deren Mittelpunkt die Vereinbarkeit mit dem Grundrecht der Berufsausübungsfreiheit der Stromnetzbetreiber steht.
