Die Krise des Finanzmarktes hat einen breiten Fächer rechtlicher und rechtspolitischer Fragestellungen aufgeworfen. Im Zentrum steht dabei die Finanzmarktregulierung. Von erheblichem Gewicht ist aber auch die Frage, wie sich der öffentliche Bankensektor, also die Struktur der Sparkassen, Landesbanken und Förderbanken, nicht zuletzt unter Berücksichtigung der Erfahrungen der Finanzmarktkrise weiterentwickeln wird und soll. Haben sich doch gerade die kommunalen Sparkassen in der Finanzkrise als besonders stabilisierender Faktor erwiesen. Von besonderer Bedeutung für die öffentlichen Banken sind auch die föderalen Fragestellungen, die durch das Finanzmarktstabilisierungsgesetz aufgeworfen werden.
Der Deutsche Landkreistag hat sich in seinem Professorengespräch 2010 mit der künftigen Organisation und Funktion öffentlicher Finanzdienstleistungen befasst. Rechtswissenschaftliche Analysen hierzu liefern Professor Dres. Winfried Kluth, Janbernd Oebbecke, Friedrich Schoch und Christian Waldhoff. Aus der Praxis berichten die Sparkassenpräsidenten Heinrich Haasis und Michael Breuer, KfW-Vorstand Dr. Axel Nawrath und Professor Dr. Hans-Günter Henneke.
Der Band veröffentlicht die - um eine Einführung des Herausgebers ergänzte - Dokumentation des Professorengesprächs, um damit die weiteren rechtlichen und politischen Erörterungen zu befruchten.
