About This Book

Susanne Geier-Thieme untersucht, wie bei der Verletzung von ImmaterialgĂŒterrechten der Union die internationale ZustĂ€ndigkeit bestimmt werden kann. Hierzu geht sie, im Gegensatz zu der Rechtsprechung des EuGH in der Rechtssache "Coty" davon aus, dass auch bei ImmaterialgĂŒterrechten eine Unterscheidung zwischen Handlungs- und Erfolgsort möglich ist. Geier-Thieme widmet sich der Frage, wie diese Orte lokalisiert werden können. Die gefundenen Ergebnisse werden mit internationalen Forschungsarbeiten verglichen und dahingehend untersucht, ob sie den Interessen aller Beteiligten hinreichend Rechnung tragen. Daran anschließend fĂŒhrt die Autorin eine ökonomische Effizienzanalyse der Gerichtsstandsregelungen durch und unterzieht diese abschließend einem Praxistest.
