Die höchst aktuelle Regensburger Dissertation befasst sich mit den Rechtsmitteln in den Verfahren nach dem neuen, zum 1.9.2009 in Kraft getretenen Gesetz ĂŒber das Verfahren in Familiensachen und in den Angelegenheiten der freiwilligen Gerichtsbarkeit (FamFG). Behandelt werden die Rechtsmittel der Beschwerde und Rechtsbeschwerde, die in §§ 58-57 FamFG geregelt und fĂŒr den gesamten Bereich der freiwilligen Gerichtsbarkeit vorgesehen sind. Dabei wird im Vergleich mit dem Rechtsmittelrecht des FGG und der ZPO der Schwerpunkt auf die Änderungen gelegt, die das FamFG gegenĂŒber der alten Rechtslage gebracht hat. Die Arbeit kommt zu dem Ergebnis, dass das Gesetz seinem selbstgesetzten Ziel, eine vollstĂ€ndige, moderne, rechtsstaatlichen Forderungen genĂŒgende Verfahrensordnung zu sein, weitgehend gerecht wird.
