Die Arbeit untersucht nach einer Darstellung der Grundlagen des Erbrechts in Deutschland und ausgewählten europäischen Staaten das Erbrecht und die Testierfreiheit in Deutschland insbesondere unter verfassungsrechtlichen Gesichtspunkten. Da das geltende Pflichtteilsrecht wegen Verstoßes gegen Art. 14 Abs. 1 Satz 1 GG als verfassungswidrig festgestellt wird, wird vorgeschlagen, es durch ein neues Familienerbrecht zu ersetzen. Hinsichtlich des Verbots des Testiervertrags kommt die Untersuchung zu dem Ergebnis, dass das Verbot weder durch die Testierfreiheit noch andere Schutzgüter geboten ist, der Gesetzgeber an einer Zulassung des Testiervertrags somit nicht gehindert ist. Für die gesetzliche Umsetzung werden sodann Textvorschläge vorgestellt.
