Das sogenannte "apodiktische Recht" des Alten Testaments erscheint in seiner klarsten sprachlichen und inhaltlichen Form im Dekalog. Im biblischen Kontext steht es damit am Anfang der mosaischen Rechtsordnung, rechtshistorisch ist es jedoch sehr spät entstanden und bildet den Abschluss und nicht den Anfang der israelitischen Rechtsentwicklung: Nicht nur der Dekalog, auch das apodiktische Recht insgesamt kann aus historischen, sprachlichen und vor allem rechtshistorischen Gründen nicht in der Frühzeit Israels entstanden sein. Es ist erst in spätvorexilischer Zeit formuliert und wie eine heutige Verfassung der Rechtsordnung vorangestellt worden. Der in der Arbeit erstmals vorgenommene direkte verfassungsrechtliche Vergleich ergibt, dass der Dekalog inhaltlich und insbesondere in seiner juristischen Funktion fast deckungsgleich einer modernen Verfassung entspricht.Die späte Schaffung des Dekalogs als übergeordnete "Verfassung" innerhalb einer Hierarchie von Rechtsnormen stellt eine einmalige, nirgendwo sonst verwirklichte rechts- und kulturhistorische Leistung Israels dar, die sich erst 2.500 Jahre später im Zuge der europäischen Aufklärung wiederholen sollte. Das Entscheidende am Dekalog ist deshalb nicht sein zeitbedingter Inhalt, sondern seine rechtliche Funktion.
