About This Book

Ziel des Vortrages ist es, den Stellenwert des deutschen Insolvenzrechts als Instrument zur Bewältigung der Finanz- und Wirtschaftskrise kritisch zu evaluieren und ggf. sinnvolle Reformvorschläge zu entwickeln. Nach einer Darstellung der ökonomischen und juristischen Ausgangslage, vor deren Hintergrund die bereits getroffenen oder geplanten Maßnahmen zur Bewältigung der Krise gesehen und bewertet werden müssen, schließen sich Überlegungen zu den Zielen und Mitteln einer Reformpolitik an. Im Zentrum des Vortrages stehen sodann außergerichtliche (vorinsolvenzrechtliche) Sanierungen, die Insolvenzordnung als Sanierungsinstrument sowie schließlich die Frage, ob es ein Sondergesetz zur Sanierung systemrelevanter Finanzinstitutionen geben sollte. Abschließend werden die wichtigsten Ergebnisse zusammengefasst.
