Este contexto de desregulación sirvió como catalizador del crecimiento incontrolable de los volúmenes y costos del litigio en salud durante el mismo período. ¿Cómo superar esta crisis? Tomando distancia de las propuestas que proponen limitar o eliminar la tutela en salud, este libro sugiere una alternativa basada en la protección regulatoria del servicio público de salud. Recuperar la regulación del sector salud es, sin duda, un proyecto más ambicioso que la simple restricción de la tutela. Pero como lo ha mostrado la Corte Constitucional (sentencia T-760 del 2008), parece ser la salida más indicada para la actual encrucijada de la salud.
