Mientras Colombia elegía a los miembros de la Asamblea Nacional Constituyente el Ejército atacó Casa Verde, el cuartel general de las FARC. En 1991 la mayoría de los constituyentes decidieron no renovar las fuerzas militares y de policía, no tocaron la justicia penal militar a pesar de los altos niveles de impunidad denunciados y negaron cualquier complicidad entre el paramilitarismo y la fuerza pública. Aunque no fueran delegatarios, los militares hicieron parte de la Asamblea Nacional Constituyente. En este libro se hace un recuento del ambiente político y el discurso jurídico en los que se instaló la Asamblea para después hacer un recorrido por las interpretaciones que siguieron a la Carta Política de 1991. Fue entonces en la jurisprudencia de la nueva Corte Constitucional donde se dieron discusiones importantes sobre los límites a la obediencia debida y al fuero militar poniendo en el centro del debate el lugar debido de las fuerzas militares en una democracia asediada por un conflicto armado. Dentro de la batalla entre interpretaciones analizada por la autora no se olvida la posición de los militares trayendo al público la jurisprudencia del Tribunal Superior Militar.
