El ataque terrorista del 11-S determinó el nacimiento de una nueva etapa del derecho internacional. No sólo implicó la materialización de un acto de hiperterrorismo, sino que determinó un cambio en la sociedad internacional, priorizando la agenda global en torno al discurso de la lucha contra el terrorismo y determinando una reconfiguración del derecho internacional, que se aparta de los principios generales que fundamentan la regulación jurídica universal. Uno de estos presupuestos vertebrales es el deber de todo Estado de abstenerse, en sus relaciones internacionales de recurrir a la amenaza o al uso de la fuerza, principio que se ha vulnerado en la llamada y discutida "lucha contra el terrorismo" con acciones armadas que han sido emprendidas en los últimos años en diferentes puntos del planeta, en aparente respuesta a ataques o amenazas de grupos que utilizan el miedo como forma de lucha. En este contexto, surge la necesidad de establecer si ¿los actos terroristas pueden ser entendidos como actos de agresión?, y en esa medida analizar si se ha modificado el ejercicio de la legítima defensa frente a actos terroristas. Este libro aborda dichas cuestiones desde el prisma del derecho a través de un completo conjunto de fuentes, que hacen de esta obra una herramienta de consulta y un instrumento para entender el derecho internacional contemporáneo.
