Este libro pretende reconstruir la historia del derecho comercial colombiano no a partir de las fuentes normativas, sino desde las sentencias de casación de la Corte Suprema de Justicia. La obra comprende el análisis de lo que podría llamarse jurisprudencia mercantil desde la Constitución de 1886, en la cual se le atribuyó a la Corte Suprema de Justicia la competencia para casar las sentencias proferidas por los Tribunales Superiores de Distrito Judicial y a través de este recurso unificar los parámetros de interpretación de las normas jurídicas a nivel nacional. Se prolongó la investigación hasta 1916 en la medida en que este corresponde al veinticinco de circulación de la Gaceta Judicial y porque durante estos treinta años los Códigos de Comercio de 1887 se mantuvieron casi incólumes en su contenido, salvo algunas pocas normas que los adicionaron.
