El presente trabajo se ocupa de la politización de la justicia y de la judicialización de la política, defectos que tienen su origen en el mismo diseño constitucional de 1991 y que parten de la concepción ingenua de que la política se vería beneficiada por la intervención de los jueces en materias tales como la elección de altos funcionarios del Estado, así como el juzgamiento penal y administrativo de los congresistas como sustituto de la inmunidad parlamentaria. Desde la óptica del derecho procesal, el trabajo ofrece un estudio de las incidencias de los principios constitucionales, analiza las leyes que se han expandido e indica sus deficiencias".
