Objectives

This is a book for the Single European Market (SEM) and for the real estate professionals operating within it. The real estate industry is europeanizing rapidly in anticipation of the SEM, with potentially even greater European integration under the provisions of the Maastricht Treaty of European Union.
This process is not, in the near future at least, one of harmonization of procedures and terminology so much as the development of expertise in handling the different national systems and the non-tariff barriers they present. This guide is designed to help the real estate professionals develop this expertise.
The objective of this guide is therefore to offer real estate and related professionals — in fact anyone in the property development business — a glossary of specialist and technical terminology, guidance on interpretation where dictionary translations may not be true equivalents, and advice on where to look for more detailed information. It is not a guide to real estate and planning systems as such, although sources for this are suggested (see section 9).
Users are assumed to have a knowledge of the language of the country in which they intend to practise, but to be seeking assistance with specialist terminology which is normally beyond the scope of foreign language courses and general dictionaries.
Real estate and planning terminology are notorious for attaching specialist meanings to words which also have everyday meanings. These specialist meanings must be understood if confusion is to be avoided. In addition, each country has its own national style of professional practice, reflected in its terminology, which is derived from the cultural as well as the legal context of professional practice in that country. Straight translations can therefore easily fail to convey the true meaning of terms in their professional practice context.
For these reasons, this guide is more than a glossary of terms in translation. We have adopted the approach of offering explanations wherever these problems may arise. Approximately one third of all entries, indicated by an asterisk (*), are treated in this way.
In order to make this manageable, a narrow definition of the field of real estate has been adopted. Terms taken from planning, construction, taxation etc. are not included unless they are central to the needs of real estate professionals and the property development process.

Objectifs

Ce guide est destinĂ© au MarchĂ© Unique EuropĂ©en (MUE) et aux professionnels de l’immobilier qui exercent leurs activitĂ©s dans ce cadre. Le secteur de l’immobilier s’europĂ©anise rapidement en prĂ©vision du MUE, et potentiellement, les dispositions du traitĂ© de Maastricht sur l’Union EuropĂ©enne prĂ©parent une intĂ©gration encore plus complĂšte.
Ce processus ne rĂ©sultera pas tant, du moins dans un premier temps, de l’harmonisation des procĂ©dures et de la terminologie que du dĂ©veloppement des connaissances des diffĂ©rents systĂšmes nationaux et des barriĂšres non-douaniĂšres qu’ils prĂ©sentent. C’est Ă  cela que vise ce guide.
Il a donc pour objet d’offrir aux professionnels de l’immobilier et des secteurs connexes, et en fait Ă  tous ceux qui s’occupent de promotion immobiliĂšre, un glossaire de termes techniques et spĂ©cialisĂ©s, des conseils d’interprĂ©tation dans les cas oĂč les dictionnaires ne fournissent pas d’équivalents exacts, et des indications permettant de trouver des explications plus prĂ©cises. Il ne s’agit pas vraiment d’un guide sur les systĂšmes de l’immobilier et de l’urbanisme de chaque pays, mĂȘme si certaines sources sont suggĂ©rĂ©es Ă  cette fin (cf section 9).
Il s’adresse Ă  des lecteurs connaissant dĂ©jĂ  la langue du pays dans lequel ils ont l’intention d’exercer leurs activitĂ©s professionnelles, mais ressentant le besoin d’une terminologie spĂ©cialisĂ©e qui n’est gĂ©nĂ©ralement pas abordĂ©e dans les cours de langues Ă©trangĂšres ni mentionnĂ©e dans les dictionnaires gĂ©nĂ©raux.
La terminologie de l’immobilier et de l’urbanisme est bien connue pour donner un sens spĂ©cialisĂ© Ă  des mots d’usage commun. Pour Ă©viter toute confusion, il faut bien saisir ce sens spĂ©cialisĂ©. Par ailleurs, chaque pays possĂšde son propre style de pratiques professionnelles, qui se reflĂšte dans sa terminologie, et qui est tirĂ© du contexte culturel et juridique de ces pratiques. C’est ainsi que les traductions littĂ©rales ne parviennent pas en gĂ©nĂ©ral Ă  exprimer le sens exact de termes utilisĂ©s dans un contexte de pratique professionnelle.
Pour ces raisons, ce guide reprĂ©sente davantage qu’un simple glossaire de mots traduits en plusieurs langues. La mĂ©thode que nous avons adoptĂ©e consiste Ă  fournir des explications toutes les fois que ces difficultĂ©s peuvent surgir. Un tiers environ des mots, indiquĂ©s par un astĂ©risque (*), font l’objet d’un tel approfondissement.
Afin de faciliter l’utilisation de ce guide, nous avons retenu une dĂ©finition restrictive du domaine de l’immobilier. Nous n’avons pas inclus de termes appartenant Ă  l’urbanisme, Ă  la construction, au fisc etc., Ă  moins qu’ils ne soient essentiels aux professionnels de l’immobilier et au processus de promotion immobiliĂšre.

Este libro estå dirigido al Mercado Unico Europeo (MUE) y a todos los profesionales de la propiedad inmobiliaria que operan en él. La industria de la propiedad inmobiliaria estå sufriendo una europeización muy råpida, anticipåndose al Mercado Unico Europeo, y con expectaciones mås amplias de integración bajo los auspicios Tratado de Maastricht para la Unión Europea.

Por tanto, el objetivo de esta guía es ofrecer a todos los profesionales relacionados con el mundo de la propiedad inmobiliaria, un glosario con la terminología específica de esta materia y una guía de interpretación en la traducción de términos que, mediante traducciones directas de diccionarios comunes, pueden llevar a error o malinterpretación. También se ofrecen indicaciones sobre dónde encontrar información mås detallada. No se trata, sin embargo, de una guía sobre la propiedad inmobiliaria y la planificación, pero sí se dan algunas sugerencias sobre estos temas (vea sección 9).
