Die Arbeit untersucht vor dem Hintergrund der jüngeren Rechtsprechung des EuGH und des BAG vor allem den Diskriminierungsschutz gemäß der missglückten Norm des § 6 AGG.Anhand einer detaillierten Analyse des Arbeitnehmerbegriffs des EuGH wird auf die Unterschiede zwischen nationalem und europäischem Arbeitnehmerbegriff eingegangen. Dabei werden insbesondere Probleme aus dem Spannungsfeld von Gesellschaftsrecht und Arbeitsrecht, die der EuGH nach Auffassung des Autors nicht sachgerecht auflöst, kritisch kommentiert und einer neuen Wertung unterzogen. Weiter zeigt die Arbeit auf, wie die Subsumtion unter unbestimmte Rechtsbegriffe der europäischen Arbeitnehmerdefinition in der Praxis gelingen kann.Der Autor ist Rechtsanwalt und berät überwiegend ausländische Investoren bei ihren Aktivitäten in Deutschland.
