About This Book

Eine stĂ€rkere Informationsorientierung der Bilanz, wie sie das Bilanzrechtsmodernisierungsgesetz (BilMoG) anstrebt, steht im SpannungsverhĂ€ltnis zu den Belangen des GlĂ€ubigerschutzes, um die es dem Kapitalschutz geht. Diese Arbeit widmet sich der Frage, ob mit dieser Reform tatsĂ€chlich eine Absenkung des Kapitalschutzniveaus verbunden ist. Es wird die neu eingefĂŒhrte außerbilanzielle AusschĂŒttungssperre des § 268 Abs. 8 HGB eingehend auf ihre Wirkungsweise und Kompensationstauglichkeit und darĂŒber hinaus die jeweiligen Modifizierungen auf ihre Kapitalschutzrelevanz hin untersucht. Hierbei ließen sich jeweils höchst gegenlĂ€ufige Auswirkungen auf die Kapitalbindung offenlegen. Nichtsdestotrotz ist festzustellen, dass das BilMoG jedenfalls keine wesentliche BeeintrĂ€chtigung der Kapitalbindung mit sich bringt.
