Die EuErbVO hat das Internationale Privatrecht (IPR) fast aller Mitgliedstaaten der Europäischen Union (EU) im Bereich des Erbrechts verdrängt. Anknüpfungspunkt ist der gewöhnliche Aufenthalt, abweichend hiervon ist eine Rechtswahl möglich. Der Autor untersucht die Möglichkeiten der Unteranknüpfung im Mehrrechtsstaat Spanien, in welchem mehrere Erbrechte (gemeinspanisches Recht und die sog. Foralrechte) gelten. Denn nach der EuErbVO ist zunächst das Interlokale Erbrecht (ILR) Spaniens entscheidend. Dieses bietet jedoch oft keine Lösung. Subsidiär ist daher auch in der Unteranknüpfung der gewöhnliche Aufenthalt maßgeblich. Eine Rechtswahl eines spanischen Teilrechts ist hingegen nicht möglich. Hat der Erblasser dennoch eine solche «falsche» Rechtswahl getroffen, ist diese wohlwollend auszulegen.
