Dieses Buch beschäftigt sich mit der Wirksamkeit von Aufhebungsverträgen, die im Zusammenhang mit einem Betriebsübergang vereinbart werden. Schon im Jahr 1987 erteilte das BAG dem sogenannten Lemgoer Modell eine Absage, auf dem auch das heute praktizierte BQG-Modell basiert. In den folgenden Jahrzehnten musste die Rechtsprechung – mangels gesetzlicher Regelung – Wirksamkeitskriterien für Aufhebungsverträge bei Betriebsübergängen entwickeln, die von der Autorin zusammengefasst und umfassend untersucht werden. Schwerpunkt ist die Frage, ob und wann ein Aufhebungsvertrag im Zusammenhang mit diesen Sanierungsmodellen dogmatisch als «unwirksames Umgehungsgeschäft» eingeordnet werden kann.
