Rechtsstaatliche Abwehrprinzipien bedürfen der konsequenten Umsetzung in allen Bereichen staatlicher Ermittlungstätigkeit. Auch das Phänomen der Internal Investigations lässt keine Ausnahme von diesem Grundsatz zu und kann die Strafverfolgungsbehörden nicht von ihrer Verantwortung freisprechen, den eigenen Anforderungen auch bei Ausnutzung privater Ermittlungsergebnisse zu genügen. Deshalb muss das intradisziplinäre Spannungsverhältnis zwischen arbeitsrechtlicher Auskunftspflicht und strafprozessualer Selbstbelastungsfreiheit durch ein selbstständiges strafprozessuales Beweisverwendungsverbot aufgelöst werden. Dies ist erforderlich, um der rechtlichen Verselbstständigung der Compliance, fernab des originären Anwendungsbereichs der Prinzipien des Strafprozesses, entgegenzuwirken und das Risiko einer Subkultur im Bereich der Wirtschaftskriminalität zu entschärfen.
