About This Book
Die Arbeit untersucht zunĂ€chst die Schutzzwecke der verbraucherschĂŒtzenden Widerrufsrechte anhand deren Genese. Sodann werden die Widerrufsrechte und -folgen dogmatisch im Systemaufbau des BGB verortet. Im zentralen dritten Kapitel werden die durch die Umsetzung der Verbraucherrechterichtlinie entstandenen materiellen RechtsschutzlĂŒcken herausgearbeitet. Dabei wird gezeigt, dass auch der grundsĂ€tzlich vollharmonisierende Charakter der Verbraucherrechterichtlinie einer Rechtsfortbildung im nationalen Recht nicht entgegensteht. In einem letzten Schritt wird aufbauend auf der dogmatischen Einordnung der Widerrufsrechte eine systemkohĂ€rente Möglichkeit zur SchlieĂung der herausgearbeiteten LĂŒcken aufgezeigt.
