Der Autor zeigt auf, dass fĂŒr die Erbringung auĂergerichtlicher Rechtsdienstleistungen ein produktbezogener Erlaubnistatbestand eingefĂŒhrt werden muss, der neben den bestehenden personenbezogenen ErlaubnistatbestĂ€nden der Rechtsdienstleistung und Inkassodienstleistung treten sollte.Zu diesem Zweck werden die existierenden Regelungen zu allen funktionalen Legal Tech-Kategorien (auch sog. smart contracts) anhand ausgewĂ€hlter Angebote umfassend dargestellt und die sich daraus ergebenden regulatorischen Herausforderungen formuliert. Im Ergebnis können weder eine Deregulierung des anwaltlichen Berufsrechts noch das UWG die QualitĂ€t von mittels Software erbrachter (Rechts-)Dienstleistungen gewĂ€hrleisten.
