Le forme ordinarie di testamento
Il legislatore, nellâart. 587 c.c., definisce il testamento come un atto revocabile con il quale un soggetto dispone, per il tempo in cui avrĂ cessato di vivere, di tutte le proprie sostanze o di parte di esse. Trattasi di negozio mortis causa , in quanto destinato a produrre effetti soltanto dopo la morte del suo autore. Nel testamento possono essere contenute anche disposizioni prive del carattere della patrimonialitĂ - come, ad esempio, il riconoscimento di figlio nato al di fuori del matrimonio (che resta irrevocabile anche in caso di revoca del testamento); la designazione del tutore del minore da parte del genitore che ha esercitato per ultimo la potestĂ ; la riabilitazione dellâindegno a succedere -, che sono efficaci anche nellâipotesi in cui manchino disposizioni di carattere patrimoniale.
