Dei delitti e delle pene è l'opera piÚ famosa dell'Illuminismo italiano scritta da Cesare Beccaria nel 1764.Beccaria si oppone all'uso della tortura e della pena di morte, considerate inumane e inefficaci per prevenire i reati, e invece propone un sistema di giustizia basato sui principi della dissuasione, della proporzionalità e della protezione dei diritti individuali. Suggerisce inoltre che la punizione per un crimine dovrebbe essere determinata dalla gravità del crimine stesso, piuttosto che dalle caratteristiche personali dell'autore dell'offesa. Il lavoro di Beccaria è stato rivoluzionario per il suo tempo e ha contribuito a plasmare il moderno sistema di giustizia. Ha influenzato lo sviluppo del codice penale in molti paesi, tra cui gli Stati Uniti e la Francia. Il libro è ancora considerato un'opera importante nel campo della criminologia ed è ampiamente studiato nelle facoltà di giurisprudenza di tutto il mondo. Cesare Beccaria (1738-1794) filosofo, giurista e criminologo fu uno dei primi sostenitori della filosofia illuminista in Italia.
