La ejecución del contrato de transporte de mercancías comporta necesariamente en algún momento una o más operaciones de carga y descarga. Estas operaciones comunes en todos los modos de transporte, engloban no solamente las propiamente tales, es decir, las de puesta o colocación de las mercancías en el modo de transporte elegido y su extracción, sino también toda una serie de operaciones previas de diversa naturaleza como las labores de depósito, clasificación, embalaje, etc. Su estudio detenido se justifica por su relevante significado económico, debido a que muchas de las pérdidas y averías de las mercancías se producen precisamente en el curso de estas operaciones. Pues bien, el objeto central de este trabajo es analizar el régimen jurídico que les resulta aplicable a estas operaciones de carga y descarga de las mercancías como una de las prestaciones del contrato de transporte, con independencia del modo de transporte empleado, terrestre, marítimo o aéreo. Se examina tanto la normativa nacional como convencional, tratando en la medida de lo posible de forma unitaria la regulación aplicable. Con este propósito, primeramente se delimita la noción de operaciones de carga y descarga de las mercancías, a continuación se analiza la asignación de estas operaciones en el contrato de transporte y su incidencia sobre el periodo de responsabilidad del porteador, y finalmente se aborda el régimen de responsabilidad por los daños ocasionados por la realización de estas operaciones tanto por las partes del contrato de transporte como por sus auxiliares.
