Die Entsorgungswirtschaft wird mehr als viele andere Branchen von staatlichen Regulierungsmaßnahmen geprĂ€gt. Um einem drohenden Entsorgungsnotstand entgegenzuwirken, entschloß sich die Bundesregierung Anfang der neunziger Jahre zu einer Neuordnung der Abfallwirtschaft. Mit der EinfĂŒhrung von RĂŒcknahme- und Entsorgungspflichten fĂŒr Verpackungen (Verpackungsverordnung) sowie dem Erlaß des Kreislaufwirtschafts- und Abfallgesetzes (KrW-/AbfG) wurde der Wandel von der öffentlichen Daseinsvorsorge zum Verursacherprinzip eingeleitet. Damit ergab sich fĂŒr die Unternehmen der Entsorgungswirtschaft ein grundsĂ€tzlich neuer, marktwirtschaftlich ausgerichteter Ordnungsrahmen. Der mit neuen Anforderungen verbundene Strukturwandel in der Entsorgungswirtschaft löste einen Konzentrationsprozeß aus, den das Bundeskartellamt aufmerksam beobachtet. Einerseits gewinnt das Kartellrecht im Zuge der Privatisierung der Entsorgungswirtschaft an Bedeutung, andererseits kann die Behörde nicht immer gegen WettbewerbsbeschrĂ€nkungen vorgehen, da in abfallrechtlichen Regelungen Konzentration und Monopolisierung angelegt sind. Diese Arbeit beleuchtet im Rahmen einer interdisziplinĂ€ren Branchenstudie die HintergrĂŒnde des SpannungsverhĂ€ltnisses zwischen Abfallpolitik und Kartellrecht.
