actual
practice,
many
suspects
are
released
before
trial
because
of
a
proce-
dural
error,
evidence
problems,
or
other
reasons
that
result
in
case
dismissal
by
the
prosecutor
(
nolle
prosequi
).
Though
most
cases
that
go
to
trial
wind
up
in
a
convic-
tion,
others
may
be
dismissed
by
the
presiding
judge
because
of
a
witness
or
a
com-
plainant’s
failure
to
appear
or
procedural
irregularities.
So
the
justice
process
can
be
viewed
as
a
funnel
that
holds
many
cases
at
its
mouth
and
relatively
few
at
its
end.
