En este texto se pone a prueba un delito en particular, denominado apología del terrorismo, en el contexto jurídico colombiano. Para tal fin, se realiza un marco conceptual que incluye, lógicamente, aspectos tales como terrorismo y libertad de expresión. Todo dentro del contexto normativo donde el respectivo tipo se inscribe, como en el sistema jurídico colombiano. Por otra parte, se realiza un detallado análisis de las características del tipo penal mencionado y los aspectos problemáticos que ha tenido en su interpretación y aplicación. Una vez hecha tal caracterización, se somete a un análisis de política criminal definido previamente y, al final, se procura examinar cuál es el fundamento ideológico que punir un comportamiento de esa naturaleza, trae consigo.
